What is the I-864?
Form I-864 is a legally binding contract in which a sponsor promises to financially support an intending immigrant. Officially, it is the Affidavit of Support Under Section 213A of the INA (I-864) . By signing, you agree to keep the immigrant's household income at or above 125% of the federal poverty guidelines until the obligation ends.
The petitioning sponsor must file an I-864 even when a joint sponsor also helps the case qualify. The obligation continues until the immigrant becomes a U.S. citizen, is credited with 40 quarters of work, or permanently leaves the U.S. after losing status — divorce does not end it.
Who needs to fill one out?
People petitioning for a relative's green card, or stepping in to help them qualify financially, typically file an I-864.
